Judge Issues Ruling on Timothy Busfield’s Release as Melissa Gilbert Reacts

Posted on January 24, 2026January 24, 2026 By author author No Comments on Judge Issues Ruling on Timothy Busfield’s Release as Melissa Gilbert Reacts

Actor and director Timothy Busfield, known for his roles in television series such as The West Wing and Thirtysomething, was released from a New Mexico detention facility this week as he awaits trial on child abuse and related charges. A judge in Bernalillo County ruled that Busfield could be freed on his own recognizance following a pretrial detention hearing, reversing an earlier decision to hold him in custody without bond. This decision allows him to return home under court supervision while the legal process continues.

The charges against Busfield stem from allegations that he engaged in improper conduct with minor cast members while directing episodes of the television drama The Cleaning Lady, which was filmed in New Mexico. Law enforcement officials have charged him with two counts of criminal sexual contact of a minor and one count of child abuse. Busfield has denied the allegations, maintaining his innocence and stating that he plans to contest the charges throughout the judicial process.During the detention hearing, the presiding judge, David Murphy, considered arguments from both the prosecution and the defense. Prosecutors urged the court to keep Busfield in custody, citing the serious nature of the accusations.

However, the judge noted that, at this stage, the evidence presented was “neutral” and that Busfield did not have a prior criminal record. Based on these factors, the judge concluded that Busfield did not pose an undue risk to the community if released under specific conditions. These include compliance with supervision by pretrial services and adherence to restrictions set by the court. The hearing was an emotional moment for Busfield’s family. Actress Melissa Gilbert, Busfield’s wife, was present in the courtroom and was visibly emotional after the judge’s ruling. Supporters, including family members and colleagues, have submitted letters to the court vouching for Busfield’s character. Gilbert has publicly expressed concern for her husband’s wellbeing and gratitude following the judge’s decision.

Under the terms of his release, Busfield is permitted to live at his home while supervised by pretrial services. Conditions imposed by the court include avoiding unsupervised contact with minors and complying with all directives from supervising officers. A preliminary hearing has been scheduled to further assess whether there is sufficient evidence to proceed to trial, and the case will move through the normal stages of the criminal justice process. As this is an active legal matter, no finding of guilt has been made, and Busfield continues to maintain his innocence. The entertainment industry and legal observers are closely watching the case as it unfolds, and future court dates are expected to shape the trajectory of the proceedings.
